UKCA Marking Penalties: What Sellers Risk
Updated 2026-10-08
Products sold in Great Britain that fall under marking law must carry the UKCA marking (or CE marking where still accepted). If an enforcement body finds a product does not meet the marking requirements, it first gets the chance to bring the product into conformity; if the seller does not cooperate, the product must be withdrawn from the market or recalled, and the seller may be liable for a fine and imprisonment. UKCA rules do not extend to the Crown dependencies or the British Overseas Territories, and legislation lets the marking sit on a label or accompanying document until 31 December 2027.
Unsure if these rules apply to you?
When UKCA marking is required
The UKCA marking applies to most product sectors that previously carried CE marking for the Great Britain market, covering areas such as electronics, toys and machinery. It is a producer's declaration that the product meets British rules; the enforcement question in this guide is what happens when the marking is missing or wrong.
The marking has a geographic edge. UKCA marking does not apply in the Crown dependencies, such as Guernsey, Jersey and the Isle of Man, and it does not apply in the British Overseas Territories. Northern Ireland runs its own arrangements, so check the dedicated guidance before deciding whether UKCA or CE marking is the right route for goods going there.
The transition window for labels
Legislation is currently in force which enables the UKCA marking to be placed on a label affixed to the product, or on a document accompanying the product, until 11pm on 31 December 2027. After that point the marking has to meet the normal rules for placement, so sellers importing stock through late 2027 should confirm with suppliers how the marking is applied rather than assuming a sticker is enough.
Special product areas carry their own timelines and rules. Cableways, construction products, marine equipment, medical devices, rail products, transportable pressure equipment and uncrewed aircraft systems each have specific provisions, so a generic UKCA checklist can be wrong for these categories.
What happens when the marking is missing
If an enforcement body finds a product does not meet UKCA or CE marking requirements, depending on the risk, they will often provide the relevant economic operator with an opportunity to work constructively to bring the product into conformity. If the economic operator fails to co-operate, they will be obliged to withdraw the product from the market or undertake a recall. The economic operator may also be liable for a fine and imprisonment.
In practice that sequence means a marketplace seller can face a compliance notice, delisting, stock seizure or a recall exercise that the seller pays for. The severity scales with the risk the product poses: a labelling paperwork fix is cheap, a full recall of an unsafe product is not.
Practical steps for marketplace sellers
Before listing, confirm the product's compliance route with your supplier in writing: which conformity assessment applies, whether UKCA or CE marking is the right mark for Great Britain, and where the marking physically appears. Ask for the declaration of conformity and technical file, and keep them; enforcement bodies ask for documents first.
If you already sell without the marking, treat a correction now as cheaper than an enforcement visit later. Pull the listing, obtain conformity documents, re-mark or relabel within the 2027 window where that is allowed, and only then relist. Platforms run their own product-compliance checks and will remove listings that cannot show a mark.

FAQ
What are the penalties for selling products without UKCA marking?+
An enforcement body first offers the chance to bring the product into conformity. If the seller does not cooperate, the product must be withdrawn from the market or recalled, and the seller may also be liable for a fine and imprisonment. The exact sanction depends on the product risk and the enforcing regime.
Is UKCA marking mandatory for all products?+
No. UKCA marking covers the product sectors that sit under British marking law, and some areas have their own rules: cableways, construction products, marine equipment, medical devices, rail products, transportable pressure equipment and uncrewed aircraft systems have specific provisions. Check whether your category is in scope before assuming a mark is needed.
Can I still sell with CE marking in Great Britain?+
In many product sectors CE marking remains accepted for a limited period alongside UKCA, and the enforcement rules treat both marks together: a product that does not meet UKCA or CE marking requirements faces the same process. Confirm the current acceptance window for your product area on gov.uk before importing stock.
What is the UKCA label deadline of 31 December 2027?+
Until 11pm on 31 December 2027, legislation allows the UKCA marking to be placed on a label affixed to the product or on a document accompanying it, rather than on the product itself. After that date the normal placement rules apply.
Who enforces UKCA marking rules?+
Enforcement bodies designated for each product regime, such as trading standards authorities for consumer products, check conformity and decide on the response: bringing the product into conformity, withdrawal, recall, or prosecution with fines and imprisonment for non-cooperation.
Does UKCA marking apply in Northern Ireland and the Channel Islands?+
UKCA marking does not apply in the Crown dependencies such as Guernsey, Jersey and the Isle of Man, nor in the British Overseas Territories. Northern Ireland has its own arrangements under a separate framework, so goods headed there need a different compliance check.
