Do Amazon FBA sellers have to collect US sales tax? (2026)
Updated 2026-07-08
Amazon usually collects sales tax on qualifying Amazon orders. That does not determine the seller's registration requirements, DTC sales obligations or inventory exposure in every state.
What Amazon usually handles
Under marketplace facilitator rules, Amazon generally collects and remits tax on qualifying Amazon marketplace transactions in sales-tax states. If you sell only through Amazon, retain the marketplace tax reports and confirm any remaining seller registration or return filing requirements by state.
But collection and seller registration are not the same legal question. Streamlined Sales Tax's marketplace-seller guidance warns that sellers may still need to register and file in some states even when the marketplace is collecting.
What still stays on the seller
Amazon marketplace tax collection does not extend to DTC and other off-Amazon sales. Test Shopify, wholesale and other non-marketplace orders under each state's economic nexus rules.
FBA inventory is the other separate review line. Inventory in a state can create physical-presence questions, but you should not turn that into a blanket national rule. Illinois' current guidance, for example, treats marketplace-only inventory differently from inventory also used to fulfil non-marketplace sales. Review the actual states involved instead of assuming FBA stock always means the same registration result everywhere.
Multi-channel FBA is where exposure usually grows
If FBA is your only channel, marketplace collection may do most of the operational work. The moment you add a direct channel, you are managing two different reviews at once: direct-sales economic nexus and inventory/physical-presence exposure.
Compare marketplace-only FBA with FBA combined with DTC or wholesale sales. The second model generally requires a more detailed state-by-state review.
When to ask a professional
Ask for a state-by-state review before registering if you have FBA inventory in several states, combine Amazon with DTC sales or are correcting late registrations. Confirm return filing requirements, exemption certificates and marketplace-only inventory treatment by state.
If you are based outside the US, prepare Amazon tax reports, DTC sales by state, FBA inventory locations and prior registration records for the state-by-state review.
